TERMS AND CONDITIONS FOR ONLINE PURCHASE

In these terms and conditions, the "Company" or "We" or mean PARKnSHOP and the "Customer" or "you" shall mean any person, firm, company or body which places an order with the Company. Please read the following terms and conditions carefully before using our site. By using our site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them. We may revise these terms and conditions from time to time by updating this posting. The revised terms will take effect when they are posted.

GENERAL


1.    Selling price and promotions at PNS eShop may be different from PARKnSHOP physical stores.


2.    The prices charged are those applicable on the day you place your order.


3.    All orders are subject to confirmation of final availability and we reserve the right to decline any order at our sole discretion. In the event that we are unable to fulfill any of the products or services in the Customer’s order, we will notify the Customer by phone or email before delivery.


4.    It is illegal to sell alcohol to people under the age of 18. By placing an order with alcohol products, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.


5.    We would like to provide you with the best shopping experience. By switching on location services, the PNS mobile app can collect your location data to personalise your app experience with location-based promotions and product recommendations, even when the app is not in use.


REGISTRATION 


6.    You are required to register before placing any order through this website. During the registration:

•    You must provide us with accurate, complete and up to date registration information;
•    You must safeguard your username and password; 
•    We assume that any person using the site with your username and password is either you or is authorized to act for you;
•    The Company has the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
•    You must inform us immediately of any changes to the information that you provided so that we can communicate with you effectively. In the event that your account is not used for a specified period (currently, 3 years), we will, for your own and our protection, deem your account to be no longer in use, and we will deactivate your account and all your accumulated points and/or e-vouchers will be forfeited (where applicable).
You will need to reapply for a new account if you wish to make further purchase at our website.
 

DAMAGE TO GOODS 


7.    The Customer is requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims (if any) must be lodged to our customer service hotline +852 2690 0948 within 7 days from the date of delivery, otherwise we shall have the discretion to refuse your claim after delivery.
 
RETURNS & REFUNDS POLICY 


8.    If the items you receive have quality issues or are incorrect, please send an email to Parknshop.info@asw.com.hk with your order no. and pictures of your item within 7 days upon receipt. Items must be returned with all the original tag, label and packaging.


9.    Please note that only one refund request can be made per order.


10.    Items cannot be returned/refunded for non-quality reasons or for reasons other than when a wrong / incorrect or quantity of the item is delivered.


11.    Currently, we offer 2 refund methods:
•    1.Refund to your eStore account as e-voucher around 3 working days upon refund request is confirmed, which can be used in your next purchase.
•    2. Refund to your relevant payment account which you applied to settle the payment of your order. The refund process generally takes around 1 to 2 weeks upon refund request is confirmed.


12.    (Note: in case you decide to use Octopus App to receive the refund, the request must be within 180 days after the transaction. You will receive a notification via your Octopus App and you are required to collect the refund via your Octopus App within 90 days.)


13.    If there is any dispute, PARKnSHOP reserves the right of final decision.
 
CASH VOUCHER 


14.    PARKnSHOP Gift Coupons are not redeemable on www.PNS.hk or for telephone ordering.
 
TITLE 


15.    All risks in the goods shall pass to the Customer upon delivery but we shall retain title in the goods until full payment has been received.

FORCE MAJEURE 


16.    The Company shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of Company.
 

PAYMENT TERMS 


17.    We accept Visa, MasterCard, American Express, WeChat Pay (HK), PayMe, Octopus App, Alipay HK for payment .


18.    All product prices listed are in HK dollars.


19.    To provide secure online commerce transactions, we employ Internet's Transport Layer Security (TLS) technology. It encrypts the Customer’s personal information, including credit card number, name and address, so that it would not be read as the information travels over the Internet. To check TLS Certificate information, you can right click the mouse and choose "Properties" & "Certificates".


20.    The single order amount must be equal or greater than HK$50.


21.    The upper limit of purchase on this website is HK$10,000 per transaction if you pay with a credit card.


22.    If you are a member of the MoneyBack Program, you may apply your MoneyBack Reward Points under your account to make purchase in our e-store at the stated redemption rate.


23.    The Customer’s offer to purchase made on www.PNS.hk shall be subject to our sole discretion and may not be accepted subject to the availability of stock or other reason. A final invoice will be presented to the Customer upon delivery.


24.    We may from time to time set credit limits for individual customers and we reserve the right to limit sales including the right to decline sales to any customers.


25.    We reserve the right to change the payment terms for any order without prior notice.
 
HOME DELIVERY 


26.    We offer free delivery for orders of HK$350 or above. For orders below HK$350, delivery fee of HK$50 shall apply (including delivery to Discovery Bay, Ma Wan, Tung Chung and Hong Kong International Airport), details as below:

NOTES 


27.    Our next day service only applies to office delivery orders.


28.    Order will be dispatched as soon as possible. The earliest delivery time would be the same day, or the latest within 10 days.


29.    For bulk purchases of more than one case, we will confirm the delivery date with you directly.


30.    In the event of a lift breakdown during delivery we will make arrangements to deliver the goods at another time.


31.    Delivery service will be suspended when the typhoon signal No.8 or above or the black rainstorm signal is hoisted. In this event customers will be contacted to re-schedule delivery time.


32.    If delivery is delayed, postponed or rescheduled due to traffic, weather, different district or other factors, the Company shall not be liable for any loss or damage, no matter whether the factor which causes the delay, postponement or rescheduling is within the control of the Company or not.
 
REMARKS 

33.    Delivery service is currently available in Hong Kong Island, Kowloon and New Territories and not available for the Outlying Islands, including Cheung Chau, Lantau Island (except Discovery Bay, Ma Wan, Tung Chung and Hong Kong International Airport). No delivery service is available to the below areas: Pui O, Cheung Sha, Tong Fuk, Shui Hau, Shek Pik, Po Lin Monastery and Tai O and areas that vans are restricted to access. No overseas delivery service is provided. The delivery orders of hospital are limited to send to registration lobby only.


34.    Delivery service is not applicable to areas that cannot be reached directly by our vehicles.


35.    If no elevator service is available for premises, home delivery service will be made up to 3rd storey only (Counting from ground floor). An additional delivery fee of HK$40 per floor will be charged for the address located above the 3rd storey where no elevator service is available (for the first 10 boxes). If the total number of boxes in order exceeds 10 boxes, the 11th to 20th boxes will be charged once more accordings to the number of floors an additional delivery fee charged, and so on without amount limitation.   Such additional delivery fee is to be paid in cash directly to the delivery driver when the items are delivered.


36.    As our vehicles cannot reach Big Wave Bay Village in Shek O without permission letters, customers are required to collect the order at designated location(s).


37.    All “Supplier Direct” orders are handled and delivery by supplier directly, which will not combine with the orders of PNS eShop. And supplier will contact you via phone / email that marked in the order record separately. Supplier will also charge certain amount for delivery free but can waive when meet the requirements of minimum spend. For the details of delivery charge please refer to FAQ.


38.    To cancel the order, please contact our Customer Service Hotline at 26900948 / email to Parknshop.info@asw.com.hk not less than 48 hours prior delivery service.


39.    Please note that all goods will be delivered as scheduled and to the best of our ability. We aim to deliver the goods when there is somebody in. We cannot accept responsibility for goods left outside at the customer's request.


40.    We reserve the right to charge an additional delivery fee if the recipient fails to accept delivery at the nominated delivery time.


41.    It is the responsibility of the customer to notify PNS.hk 24 hours before delivery of any change to the delivery address after placing the order.


42.    We reserve the right to decline delivery of goods to any customer at our sole discretion absolutely. 


CLICK & COLLECT 


The services of ‘Click & Collect’ is available for orders upon $100. For order below $100, $20 service charge shall apply.

How it works
After adding the items to cart, select ‘Click & Collect’ as the preferred ‘Delivery Method’ and choose your desired location for pick-up, then proceed to make payment for your order. Once payment has been confirmed, you will receive an order summary email with the details of your order and collection point.

When and How to pick up
Once your order is ready for collection, an order confirmation email will be sent to you. Please don’t arrive before you have received the order confirmation email. To pick up the order, please present your order confirmation email when collecting in store. Please note your signature is required after checking your ordered items for order pick-up.

Pick-up period of "Click & Collect" order
Order must be picked up within 3 days upon receiving an order confirmation email. If customer fail to collect the order within the pick-up period, PARKnSHOP reserves the right to cancel the order.
 

SUPPLEMENTAL TERMS AND CONDITIONS FOR PNS SUPPLIER DIRECT SERVICE 
These terms and conditions govern the supply of products ("products") listed for sale on the Supplier Direct service, which is made available on PNS website or mobile application (the “site”). These terms and conditions are supplementary to the Terms and Conditions for Online Purchase stated above, which also apply to purchases made on the Supplier Direct service. In the event of any conflict, these terms and conditions shall take precedence over the Terms and Conditions for Online Purchase.
Please read these terms and conditions carefully before ordering any products from the site. You should understand that by ordering any of the products on the Supplier Direct service, you agree to be bound by these terms and conditions. Where a sale and purchase is agreed through the Supplier Direct service, a contract of sale is established solely between you and the supplier pursuant to these terms and conditions.


HOW THE CONTRACT IS FORMED BETWEEN YOU AND THE SUPPLIER
1.    By agreeing to these terms and conditions during the checkout process, you are agreeing to enter into a contract of sale with the Supplier. We act as an agent in the name of and on behalf of the Supplier in concluding a contract of sale between you and a Supplier, and in handling certain related ancillary obligations on the Supplier’s behalf. We are not a party to any contract of sale between you and a Supplier, and where a sale and purchase is agreed through the Supplier Direct service, the contract of sale is established solely between you and the Supplier.

2.    You may place an order to purchase a Product advertised for sale on the Supplier Direct service by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the "Checkout" button. No amendments can be made by you to your order after this point.

3.    After placing an order, you will receive an e-mail from us acknowledging that we, on the Supplier’s behalf, have accepted your order. There may be situations when your order is subsequently cancelled, if for example, the Supplier does not have your Product in stock. In this instance you will be refunded in full via the same payment method, and we nor the Supplier will accept any liability whatsoever for such cancellations. If there are no issues with fulfilling your order, you will receive an email, phone call, SMS, WhatsApp message or any other form of communication advising you when the Product has been dispatched. The contract between you and the Supplier for the sale of a Product will be formed once we send you an email confirming your order. If you order several Products, each contract is formed between you and the respective Supplier as soon as we accept the order and send you a confirmatory email.

4.    The Supplier will not be obliged to supply any other Products in addition to what you have ordered.

5.    We may choose not to accept your order for any reason, and we will not be liable to you or to anyone else in those circumstances.

6.    We may be unable to process your order if:
•    the Product you ordered is out of stock or discontinued; or
•    there is a problem with authorisation of your method of payment.

7.    Certain Products made available on the Supplier Direct service are subject to age restrictions imposed by law. Suppliers are not permitted by law to supply these Products to individuals who do not satisfy the relevant age requirement and, if you are underage, you must not attempt to order these Products. By using the site and / or making a purchase, you confirm and certify that you are of a legal age to purchase those Products.


DELIVERY
8.    The Supplier will deliver the Products to your address which must be situated in Hong Kong, in accordance with the delivery option specified by you when you placed your order.

9.    The Supplier will dispatch all Products comprised in your order at the same time albeit on some occasions in multiple packages. Delivery will be made to the delivery address specified in your order. The Supplier will provide to you information on where it delivers and the available delivery options. The Supplier may not be able to deliver items within the same order to multiple addresses. Neither we nor the Supplier are responsible for any additional carrying or positioning of Products ordered.

10.    There may be a delivery charge, which will be added when you checkout. Please make sure that you are satisfied with the delivery charge before confirming your order for Products at checkout.

RISK AND OWNERSHIP
11.    Once delivered, the Products ordered will become your responsibility and, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered, neither we nor the Supplier will accept any liability for their loss, damage, or destruction after they have been delivered.

12.    Ownership of Products will pass to you on: delivery of the Products; or us receiving full payment of all sums due in respect of the Products on the Supplier’s behalf, whichever is the later.

PLASTIC SHOPPING BAG CHARGE

Plastic shopping bag charge will be applied if purchase of any fresh, chilled and frozen food. The charge is $2 for 1 to 5 items, $3 for 6 to 10 items, $4 for 11 to 15 items, and $5 for 16 to 20 items. The maximum charge is $5.

Plastic Shopping Bag Charge not applicable to all promotions, discounts and rewards.

No refund service for Plastic Shopping Bag Charge.

These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and the Company agree to submit to the exclusive jurisdiction of the Hong Kong courts. The Company may revise these terms and conditions at any time without prior notice. If any dispute arises, the Company's determination shall be final. Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
